Welcome to Nannies and Kids. By using our services, you agree to comply with the following terms and conditions. Please read them carefully before engaging with our agency. If you do not agree to these terms, you may not use our services.
1. Definitions
- “Agency” refers to Nannies and Kids, based in Vancouver, BC.
- “Client” refers to any individual or family using the Agency’s services to find a nanny.
- “Nanny” refers to any individual seeking employment through the Agency.
- “Services” refers to the recruitment, screening, and placement of nannies with clients.
2. Agency Services
- The Agency provides recruitment, vetting, and placement services to match clients with suitable nannies.
- The Agency performs background checks, verifies references, and confirms certifications (e.g., First Aid/CPR) for all nannies.
- While the Agency strives to provide high-quality matches, we cannot guarantee the suitability, performance, or long-term availability of any nanny.
3. Client Responsibilities
- Clients must provide accurate and complete information about their childcare needs and household requirements.
- Clients are responsible for establishing a clear employment agreement with the nanny, including salary, hours, duties, and other relevant terms.
- Clients are required to comply with all applicable labour laws, tax regulations, and employment standards in British Columbia.
4. Nanny Responsibilities
- Nannies must provide accurate and truthful information about their qualifications, experience, and availability.
- Nannies are required to comply with all agreements made with the client and maintain professionalism at all times.
- Nannies must inform the Agency of any changes to their availability or circumstances that may impact their ability to fulfill their duties.
5. Fees and Payments
- Clients are required to pay placement fees as outlined in their agreement with the Agency. Fees may vary depending on the type of placement (e.g., full-time, part-time, temporary).
- All fees are non-refundable unless otherwise specified in the agreement.
- Payment must be made in full before the nanny’s start date unless other arrangements are agreed upon in writing.
6. Replacement Policy
- If a nanny leaves the position within the first 90 days, the Agency may offer a one-time replacement at no additional cost, provided the client has complied with all terms and conditions.
- The replacement policy does not apply if the nanny’s departure is due to unreasonable working conditions, changes to agreed terms, or non-compliance with labour laws.
7. Limitation of Liability
- The Agency is not liable for any disputes, damages, or losses arising from the employment relationship between the client and the nanny.
- The Agency’s liability is limited to the services explicitly outlined in the agreement.
- The client assumes full responsibility for managing the employment relationship and ensuring compliance with applicable laws.
8. Confidentiality
- The Agency respects the privacy of clients and nannies and will not share personal information without consent, except as required by law.
- Clients and nannies agree to keep any shared personal information confidential and use it solely for the purposes of the employment relationship.
9. Termination of Services
- The Agency reserves the right to terminate services at any time if the client or nanny breaches these terms and conditions.
- Clients may terminate their engagement with the Agency by providing written notice. However, any fees paid are non-refundable.
10. Governing Law
These terms and conditions are governed by the laws of the Province of British Columbia, Canada. Any disputes shall be resolved in the courts of British Columbia.
11. Amendments
The Agency reserves the right to update or modify these terms and conditions at any time. Clients and nannies will be notified of significant changes, and the updated terms will be posted on our website.
